Terms of Service

1. Acceptance of Terms

By accessing and using Selampandai ("the Platform," "Service," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

Use of the Platform is at your own risk. We provide the Platform on an "AS IS" basis without warranties.

2. User Eligibility

You represent and warrant that:

• ✅ You are at least 13 years old (or have parental consent if younger)
• ✅ You are not legally prohibited from using this service
• ✅ All information you provide is accurate and truthful
• ✅ You will not impersonate others or provide false information

Breach of eligibility: We may suspend or terminate your account without refund.

3. User Accounts & Conduct

3.1 Your Account

• CID (Competitor ID): Unique identifier assigned to you on signup
• Family accounts: Parents can create child accounts linked to their profile. Parents are responsible for their children's activity on the Platform
• Responsibility: You are responsible for all activity on your account, including registrations made on behalf of family members
• Security: Keep your password and login secure
• Notification: Inform us immediately if your account is compromised

3.2 Device Security

Your account remains logged in on this device for up to 30 days after you sign in.

You are responsible for:

• Keeping your device secure (lock screen, PIN, biometrics)
• Logging out on shared or public devices
• Reporting a compromised account immediately

If your device is lost or stolen: log out immediately from another device by visiting your profile and choosing "Log out all sessions".

3.3 Prohibited Conduct

You agree NOT to:

• ❌ Create multiple accounts to circumvent bans or manipulate rankings
• ❌ Create fake family/child accounts to gain extra registration slots or manipulate rankings
• ❌ Impersonate others or claim false achievements
• ❌ Post offensive, abusive, or harassing content
• ❌ Share explicit or illegal content
• ❌ Spam, scam, or exploit other users
• ❌ Disrupt tournaments or events through cheating or manipulation
• ❌ Reverse-engineer, hack, or attempt to breach the Platform
• ❌ Interfere with Platform operations or services
• ❌ Collect data through scraping or unauthorized methods
• ❌ Use automated bots or tools to artificially inflate stats

Violation consequence: Account suspension or permanent termination, without refund.

4. Events & Tournaments

4.1 Event Creation

Any signed-in user may create and manage events. Events by approved organizers are verified and award full ranking points; community events award ranking points at half the verified rate and provide the same check-in and results tools. As an event organizer, you agree to:

• ✅ Provide accurate event details (date, time, location)
• ✅ Honor your posted event schedule
• ✅ Manage the event fairly and professionally
• ✅ Respect all participants
• ✅ Post accurate results in a timely manner
• ✅ Comply with all applicable laws

Organizer responsibility:

You are liable for safety and security of your event venue, conduct of your tournament, accuracy of posted results, and fair treatment of participants.

4.2 Event Participation

As a participant, you agree to:

• ✅ Follow the organizer's event rules
• ✅ Compete fairly and honestly
• ✅ Respect other competitors
• ✅ Show up on time or notify organizer of withdrawal
• ✅ Accept results as posted
• ✅ Provide accurate first name, last name, and phone number when an event requires contact collection
• ✅ If registering multiple slots, ensure you can fulfill all slot commitments
• ✅ Check in at the venue — either at the desk or by scanning the event's venue QR and confirming your slot

Disqualification: Organizers may disqualify participants for cheating or misconduct.

4.3 Walk-In Participants & Coordinators

• Walk-in participants: Organizers may register non-member players on-site, and guests may check themselves in via the venue QR link by entering a name. Walk-in display names are recorded for the event and appear in results and rankings
• Coordinators: Organizers may grant trusted users coordinator access to manage their events. Coordinators act on the organizer's behalf; the organizer remains responsible for their actions

4.4 Event Reviews

• Players who checked in to an event may leave a verdict (recommended, can be better, or not recommended) and an optional comment
• Reviews are shown publicly under your display name — keep them honest and respectful
• Reviews that violate the content rules in Section 3 may be removed

4.5 Results & Rankings

• Accuracy: We calculate rankings based on organizer-posted results
• No guarantee: We do not verify accuracy of results
• Disputes: Contact the event organizer, not us
• Corrections: Rankings update when organizers correct results

We are not responsible for:

• Incorrect results posted by organizers
• Disputes between participants and organizers
• Fairness of tournament rules

5. Photos & Content

5.1 Event Photos & Podium Results

When you participate in an event or have your photo posted:

• ✅ Your name and placement appear publicly on the Platform
• ✅ Event photos may be displayed on the Platform
• ✅ Results may be shared with other players
• ✅ You cannot request removal of historical results

What this means:

• Your tournament placements are permanent public record
• Your name appears on leaderboards and rankings
• This is similar to how sports rankings work

5.2 Your Profile Photo

• You grant us permission to display your photo on your profile
• You can update or remove your photo anytime
• You confirm you own rights to your photo

5.3 Organizer-Posted Photos

• Event organizers may post photos of tournaments
• These photos may include you as a participant
• You implicitly consent to this by participating in public tournaments

6. Intellectual Property

6.1 Platform Content

• Platform design, code, features: Owned by Selampandai
• Logos, branding: Protected intellectual property
• You cannot: Copy, reproduce, or redistribute Platform code/design without permission

6.2 Your Content

• Your posts & results: You retain ownership
• License to us: You grant us permission to display your results, name, and podium placement
• This includes: Using your achievement data in rankings and leaderboards

7. Limitation of Liability

7.1 Disclaimer

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES.

We do not guarantee:

• ❌ Uninterrupted service
• ❌ Error-free operation
• ❌ Accuracy of rankings
• ❌ Security against all attacks
• ❌ Data recovery after deletion

7.2 What We're NOT Liable For

To the maximum extent permitted by law:

We are not liable for:

• Loss of data or rankings
• Service interruptions or downtime
• Loss of income or opportunity
• Disputes between users or organizers
• Third-party actions or breaches
• Incorrect results posted by organizers
• Injuries or damage at event venues (organizer's responsibility)

Your remedy: Discontinue use of the Platform

7.3 Liability Cap

Our total liability to you is limited to RM100 (refund of any fees paid, or nominal compensation).

8. Indemnification

You agree to indemnify and hold harmless Selampandai from:

• Claims arising from your use of the Platform
• Your violation of these terms
• Your violation of any laws
• Disputes with other users or organizers
• Your posted content

In plain English: If you break the rules and get sued, you pay for it, not us.

9. Dispute Resolution

9.1 Between You & Us

If you have a dispute with Selampandai:

1. Step 1: Email us at selampandaiofficial@gmail.com with details
2. Step 2: We respond within 30 days
3. Step 3: If unresolved, proceed to mediation or small claims court

9.2 Between You & Other Users

If you dispute another user or organizer:

• We are not a referee — Disputes are between you and them
• We do not settle disputes — Contact the organizer directly
• Escalation: If harassment/abuse, report to us and we'll take action

10. Account Termination

10.1 We May Terminate Your Account If:

• Violating these terms or any applicable laws
• Engaging in harassment, abuse, or fraud
• Creating multiple accounts to circumvent rules
• Breaching our acceptable use policy
• As required by law

10.2 Upon Termination

• Your account access is revoked immediately
• Your results remain in historical records (cannot be deleted)
• No refunds will be issued
• You may create a new account (if not banned)

10.3 You May Terminate

• Email selampandaiofficial@gmail.com to delete your account
• Your personal data will be removed within 30 days
• Your historical results remain in leaderboards (for integrity)

11. Third-Party Services

We use third-party services:

We are not responsible for their services. Use at your own risk.

12. Modifications to Terms

We may update these Terms of Service:

• We will notify users of material changes
• Continued use after notification = acceptance of new terms
• Your only remedy for disagreement is to stop using the Platform

13. Governing Law & Jurisdiction

• Governed by: Laws of Malaysia
• Jurisdiction: Courts of Sarawak, Malaysia
• Dispute location: Kuching, Sarawak

14. Severability

If any part of these Terms is found invalid or unenforceable:

• That part is severed
• Remaining terms remain in effect
• Both parties agree to modify only the invalid part

15. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Selampandai.

No other:

• Emails, conversations, or verbal agreements are binding unless in writing
• Representations or warranties are made beyond those stated here
• Previous agreements override these terms
